TASSIMO - Home Delivery Service - Terms and Conditions (inc Ireland)

1. Introduction

1.1 The TASSIMO Home Delivery Service is offered subject to these terms and conditions by Kraft Foods Schweiz GmbH, 8152 Glattpark (registered number 02030046329) Umsatzsteueridentifikationsnummer 162419.
UK: VAT Number 894455673.
Ireland: NL 8174.58.876.BO1.

1.2 If calling from within the UK please call 0800 032 88 33 for the TASSIMO Home Delivery Service, if calling from Ireland please call 1800 600 858. The Home Delivery Service takes phone orders between 8.00 am and 6.00 pm Monday to Friday.

2. Terms and Conditions

2.1 The conditions detailed below do not affect your statutory rights.

2.2 The way in which we process and protect your data is contained in our published Privacy Policy on the website at www.tassimo.co.uk.

3. Products

This TASSIMO Home Delivery Service sells T DISCs and other TASSIMO related items.

4. Prices

All prices are inclusive of VAT within the UK and Ireland where appropriate.

5. Ordering & Payment

5.1 You can order our products in two ways:

5.1.1 On-Line using our website www.tassimo.co.uk; or

5.1.2 By telephone on 0800 032 88 33 from within the UK, or 1800 600 858 from Ireland. The Tassimo Home Delivery Service is a freephone/lowcall number.

5.2 We will endeavour to deliver all the products you order. In the unlikely event of any product being out of stock at the time we will notify you of this and hold your order until the missing item(s) is/are available. This may affect the normal delivery schedule.

5.3 Whilst every effort will be made to ensure that all items shown in our on-line product catalogue are in stock we offer no guarantee of availability and our telephone service and this electronic publication does not constitute an offer for sale capable of acceptance by you submitting an order.

If ordering on-line, when we receive your order we will automatically send you an e-mail confirming acknowledgement of receipt of your order details. This e-mail will be directed to the e-mail address you supplied to us upon placement of your order and is not a guarantee of availability nor acceptance of an offer.

Monies will not be deducted from your credit card/switch card until the products are despatched. All costs are quoted in GBP £.

A contract will only be formed when the products are delivered to you.

5.4 If you are experiencing any difficulties processing your order/credit card or debit card payment, please call our UK Help Line on 0800 032 88 33 or our Irish Help Line on 1800 600 858.

5.5 You will be issued with a unique order reference number when ordering by telephone - please quote this in case of any queries. If you have ordered via the website then please provide your postcode if you have any queries.

5.6 To ensure your order is dealt with promptly, we require your full, correct address details, including a postcode for the UK/a county for Ireland, a day time contact telephone number and your e-mail address (if applicable). Please also include your TASSIMO Unique Client Number (found on the registration card) if you have one.

5.7 We are unable to accept money off vouchers through the TASSIMO Home Delivery Service - these can usually be redeemed for the specified TASSIMO products in TASSIMO stockists.

5.8 All investigations for order traces will be implemented as soon as possible. Queries need to be directed to our service operator on 0800 032 88 33 if dialling from within the UK and 1800 600 858 if calling from Ireland; you will need to give the operators your unique order number if you have ordered by telephone. If you have ordered using the website, you will need to quote your postcode. The Home Delivery Service accepts telephone orders from 8.00 am to 6.00 pm Monday to Friday.

5.9 Your order will only be processed if full payment details are given. We currently accept payment by Visa, MasterCard and Maestro.

5.10 All orders are positively credit card sanctioned prior to despatch, so please ensure that the details you provide us with are correct. We cannot accept responsibility for an order being held back as a result of incorrect or invalid payment details being given. The address you provide to us must be the same as the billing address you have notified to your selected credit/debit card company as this is used to validate your order. We regret that failure to supply the correct details will result in your order being held pending the supply of the correct details.

5.11 The total value of your order will be displayed on the order confirmation screen. The displayed price is the amount in pounds sterling that you will pay or if you order by phone, you will be notified by the operator of the amount payable.

5.12 The minimum order quantity we will accept is to the value of £16 of T DISCS.

5.13 Prices detailed at the point of ordering (subject to revision for errors) will be the prices charged.

6. Delivery

6.1 We can deliver as many products as you wish up to 25 kilos for the one-off delivery charge.

6.2 We regret we are unable to accept orders for delivery to an address containing a PO Box Number, or from persons placing an order whose address contains a PO Box Number.

6.3 Subject to 6.2 above, deliveries will be made to the address that you have nominated. In the event that you select a business address, TASSIMO shall be deemed to have delivered the product to its intended recipient by delivering it to the reception area at the business address. However, if an express delivery has been selected, your signature will be required or the products will not be delivered.

6.4 Standard Delivery Service (Mainland UK + Northern Ireland ONLY):

6.4.1 A delivery charge of £4.50 will be added to your order - UK mainland only, see 6.4.4 below.

6.4.2 The £4.50 delivery charge is waived for orders placed to the value of £30 or more in a single delivery, up to the maximum specified in condition 6.1 above - UK mainland Northern Ireland, the Republic of Ireland and the British Isles only.

6.4.3 Delivery will normally take approximately 5 working days for UK Mainland, Northern Ireland and the Republic of Ireland. No deliveries are made on Saturdays, Sundays or Bank Holidays.

6.4.4 Deliver may take up to 11 working days for the British Isles (Isle of Man, Isle of Wight, Channel Islands, Scottish Isles) No deliveries are made on Saturdays, Sundays or Bank Holidays.

7. Cancellation of order/returns policy

7.1 Please contact us before returning goods: Telephone no. 0800 032 88 33 from within the UK and 1800 600 858 from Ireland. Carelines are open 8.00 am to 6.00 pm Monday to Friday.

7.2 We regret that returns are not Freepost unless the product is defective.

7.3 You have the legal right to cancel your order at any time without reason, subject to Clause 7.4 below, within 7 working days of delivery, starting on the day after delivery.

7.4 Should you wish to return your order, you should return it to the address given to you when you contact the Careline. Please insert a copy of your delivery note into your return parcel and retain your receipt or proof of postage.

7.5 If you exercise your right to cancel, subject to condition 7.4 we will return your money to your account within 5 days of receipt of returned product. The refunds will be made in GBP £.

7.6 We are unable to accept cancellation or returns of purchases which have been used or opened unless the product is defective.

8. Security

8.1 Our payment process is digitally encrypted using SSL technology to transfer your details to our secure server. We hold your credit card details to speed up the order process for you.

8.2 SSL is the industry standard for secure on-line payment, it provides a high level of protection to you against credit card fraud, and to us against fraudulent use of credit cards.

9.2 We aim to acknowledge all queries within 3 working days, and deal with complaints within 5 working days.

10. General

10.1 We reserve the right to supplement and amend these Terms and Conditions. It is your responsibility as a customer to review these on each occasion you access the TASSIMO Home Delivery Service.

10.2 We also reserve the right to suspend, restrict or terminate access to the TASSIMO Home Delivery Service for any reason at any time.

10.3 These Terms and Conditions shall be governed by English law and the English courts shall have jurisdiction over any disputes.

11. Liability

We will not be liable for any theft or loss of or destruction to your products once the products are delivered to your nominated delivery address. If you are concerned about such risk you may wish to arrange an Express Delivery (available within the UK mainland only).

12. Trade Marks & Copyright

12.1 We own all the rights in the designs and information on the website (www.tassimo.co.uk). You may only print out parts of the website for the purpose of ordering products on the website. You must not use the material on the website for any other purpose.

12.2 "TASSIMO", "KENCO" and "SUCHARD" and "T DISC" are our registered trademarks and other products names featured in the website may be registered trademarks belonging to other organisations, and must not be copied o used without their permission.
